The phrase “Fair Market Value” (“FMV”) is often touted amongst healthcare attorneys, but depending on the context it has a specific, defined meaning. Importantly, however, FMV is often the driving factor in identifying whether a particular transaction is compliant with federal (and sometimes state) regulations.
